We provide the following legal services to our national and international clients: patent searches, patentability opinions, patent drafting, patent prosecution, designing around valid U.S. Patents, patent licensing, patent infringement litigation, copyright and internet law, trademark searches, trademark filing and prosecution, trade dress protection, trade names, trademark licensing, defense of trademark infringement, keying or keyword infringement, seizure of counterfeited products by US Customs and International Trade Commission, cancellation and opposition proceedings before the Trademark Trial and Appeal Board (TTAB).  

The Firm represents clients in proceedings before the TTAB. There are four types of proceedings before the TTAB: opposition proceedings; cancellation proceedings; interference proceedings; and concurrent use proceedings. An opposition proceeding is a proceeding in which one party seeks to prevent the issuance of a registration of a mark of another party. A cancellation proceeding is a proceeding in which one party seeks to cancel an existing registration of a trademark of another party. An interference proceeding is a proceeding in which the Board determines which, if any, of the owners of conflicting applications or registrations is entitled to registration. A concurrent use proceeding is a proceeding in which the Board determines whether one or more applicants is entitled to a concurrent conditional registration. Overall, a TTAB proceeding is similar to a civil action in a Federal district court with regards to pleadings and discovery with some differences.
